Terms & Conditions

1. User Data

  Please be aware that it is your responsibility to keep this up to date and any information given will not be passed on to any third party.

2. Contract

  2.1 We must receive payment of the whole of the price for the goods that you order before your order can be accepted. When you place an order online on this website you are making an offer to buy goods.

  2.2 Once payment has been received by us we will confirm that your order has been accepted by sending an email to your email address. The contract is then confirmed.

3. Images and Descriptions

  3.1 Every attempt is made to portray items as accurately as possible although slight variations may occur.
  Some items may require self-assembly and all measurements are approximations.

  3.2 The reproduction of the colour is as accurate as technical limitations will allow; the colours shown on this website may not match exactly with the end result. Maxwells DIY cannot be held responsible for any variations between product and swatches shown

4. Price

  Payable prices are set on the website. Prices are accurate and include VAT. Prices may differ from items seen in-store depending on stock/supplier and availability

5. Right for you to cancel your contract

  5.1 You may cancel your contract with us for the goods you order at any time up to the end of the 15th working day from the date you receive the ordered goods and providing you contact us by email stating that you wish to cancel your order and brief reasons why you are rejecting the goods.

  5.3 Once you have notified us that you are cancelling your contract, any sum debited by us from your credit card will be re-credited to your account as soon as possible and in any event within 15 working days of receipt by us of the  goods returned by you and received by us in the condition they were delivered to you.

  5.4 Refunds can only be completed through your original payment method. Card payments may take 3-7 working days and PayPal can take 24 hours before your funds are available

  5.5 This cancellation policy does not affect your statutory rights.

6. Cancellation by Maxwell’s DIY

  6.1 We reserve the right to cancel the contract between us if: We have insufficient stock to deliver the goods you have ordered

  6.2 We do not deliver to your area If we do cancel your contract we will notify you by email and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 15 days of your order.

  6.3 We will not be obliged to offer any additional compensation for loss or disappointment suffered.

7. Delivery and Order Dispatch

  7.1 We will deliver the goods on a named or economy deliveries  to the addresses given within these areas:
  All England & Wales postcodes
  Selected Scottish Postcodes:
  DD, DG, EH, FK, G, KA (except KA27 & KA28), KY, ML, TD, AB1-AB16, AB21-AB25, AB30, AB39, PA1-PA19, PH1-PH3
  All items are subject to availability.

  7.2 When a delivery is delayed due to stock availability or unforeseen factors we will advise you of the delay as soon as practicable. We will provide an estimate of the likely dispatch date and allow you to cancel your order if this is unacceptable to you by notifying us by email of your wish to do so at any time before the estimated dispatch date.

 7.3 If we have insufficient stock to make your order, we will notify you as soon as possible and inform you of this along with the new delivery date. If this is unacceptable you may cancel your order before the new dispatch date by informing us via email. Orders cannot be delivered or collected on bank holidays regardless of the delivery amount paid, they will be delivered or collected the following working day.

 7.4 Maxwells DIY is not responsible for any items lost due to customer requests for items to be left in a safe area, deliveries are left at your discretion  

 7.5 If the order has been refused or cancelled after dispatch, the delivery charge paid will not be refunded. 

 7.6 If the order fails to be delivered due to you not being in, we will do our best to accommodate you however our courier will only hold items for 30 days. If it has still not been delivered your order will be returned to us, a refund for the items will be issued but the delivery charge paid will not be refunded. 

 7.7 If an order delivered via PalletTrack is refused, the delivery charged paid will not be refunded and a further delivery charge will be deducted from your final refund to cover the cost of return. 

8. Liability

  8.1 If the goods we deliver are not what you ordered or are damaged or defective we shall replace the item or provide a full refund once proof of damage or incorrect items (a photo of the items) has been provided. This must be done within 30 days of receiving the goods. 

  8.2 For unwanted or mistaken orders we shall have no liability to you unless you notify us of the problem within 15 working days of the delivery of the goods in question.

  8.3 We will not be liable to you for any indirect or consequential loss, damage, expense (including loss of profits, business or goodwill)

  8.4 We do not have any liability to pay any money to you by way of compensation other than to refund the amount paid by you for the goods in question, only if items are not received or returned. 

9. Changes to the Terms and Conditions

  We reserve the right to change the Terms and Conditions, other documents, policies and website content at any time.
